By checking this box you agree that roomLift is an interior design consulting service only. roomLift does not sell any furniture, furnishings or accessories (collectively "Merchandise"). This means that if you decide to purchase any Merchandise based on our suggestions, then all of your connections shall be between you and that particular vendor, and you expressly agree that roomLift will not be responsible for any issues relating to Merchandise, including but not limited to manufacturing imperfections, mislabeled dimensions, shipping problems, late deliveries, out-of-stock items, or vendor price changes. All measurements should be verified by the customer prior to purchasing product. You understand that all vendor prices, lead times, color swatch and availability are approximate and may vary. You also understand that vendors change their pricing from time to time and therefore any prices provided by roomLift are not guaranteed. Further, any Merchandise purchased by you may be subject to additional charges for shipping and taxes. You also agree that roomLift will not be responsible for inadvertent mis-measurements of suggested furnishings. Similarly, roomLift cannot be responsible for confirming that suggested furniture will fit through your doorways, hallways, stairways, or elevators. All sketches and/or floor plans prepared by roomLift are: (i) based on dimensions and other information provided by you; and (ii) are intended for design purposes only; and (iii) cannot be used for construction. If you believe that renovation/construction is (or may be) necessary, roomLift recommends that you consult with a license professional prior to undertaking any such activity. roomLift recommends that you always test paint colors on your walls prior to painting, and that you look at the sample colors at different times of the day and in different lights.
You agree that roomLift's total liability to you in regard to any claims arising out of or relating to this Agreement, or the services performed will not, for any reason, exceed the total amount of fees actually paid by you to roomLift under this agreement. roomLift will not be responsible for any consequential or punitive damages. You agree that no action for breach of this Agreement may be brought more than one year after the completion of services by roomLift.
